Terms of Use

1. Eligibility and acceptance

You must be legally capable of agreeing to these Terms. If you use the Site on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

2. Prelaunch information only

The Hero App is in development. The Site describes intended product direction and possible pilot features. It is not currently a booking service, technician marketplace, dispatch service, estimate, professional recommendation, or guarantee that any feature, service category, location, technician, response time, launch date, or commercial term will become available.

Joining a waitlist or contacting us does not create a customer, technician, employment, agency, partnership, franchise, or other service relationship. Pilot participation and access may be limited, changed, or declined.

3. Safety and emergencies

The Hero App is not an emergency-response service. Do not use or rely on the Site for immediate threats involving life safety, fire, gas, crime, medical emergencies, major electrical hazards, structural danger, or uncontrolled flooding. Contact 911, police, fire, emergency medical services, the appropriate utility, or another qualified emergency resource first.

Website content is general information and is not a substitute for professional diagnosis, safety advice, trade expertise, or compliance with applicable codes, permits, licensing, and inspection requirements.

4. Acceptable use

You may use the Site only for lawful purposes. You must not:

• Submit false, misleading, unlawful, harmful, or infringing material.
• Impersonate another person or misrepresent your authority or affiliation.
• Attempt to bypass security, probe systems, introduce malicious code, scrape at unreasonable volume, or interfere with Site operation.
• Use Site content or contact information for unsolicited marketing, automated profiling, or unlawful data collection.
• Reverse engineer or exploit the Site except where such restriction is prohibited by law.

We may restrict access or disregard submissions that appear abusive, automated, fraudulent, unsafe, or inconsistent with these Terms.

5. Site content and intellectual property

The Site, brand elements, logos, designs, text, video, graphics, software, and other content are owned by or licensed to The Hero App and are protected by applicable intellectual-property laws. Subject to these Terms, you may view the Site for personal or internal business evaluation. No other licence is granted.

Your submissions

You retain ownership of information you submit. You give us a non-exclusive licence to host, reproduce, transmit, and use that information as reasonably necessary to respond to you, manage early-access interest, evaluate pilot opportunities, operate the Site, and exercise the purposes described in our Privacy Policy. You represent that you have the right to provide the submission.

6. Third-party services and links

The Site may rely on or link to third-party services. We do not control third-party content, availability, security, or privacy practices. Your use of a third-party service may be governed by separate terms.

7. Disclaimers

To the maximum extent permitted by law, the Site is provided “as is” and “as available.” We do not promise that the Site will be uninterrupted, error-free, secure, complete, current, or suitable for a particular purpose. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

8. Limitation of liability

To the maximum extent permitted by law, The Hero App and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, goodwill, or anticipated savings arising from the Site. For claims relating solely to free use of this prelaunch Site, our aggregate liability will not exceed USD $100.

These limitations do not apply to liability that cannot legally be limited or excluded.

9. Indemnity

To the extent permitted by law, you agree to indemnify The Hero App from third-party claims, losses, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, or content you submit in violation of another person’s rights.

10. Changes and availability

We may change, suspend, or discontinue any part of the Site and may update these Terms. Updated Terms become effective when posted unless another date is stated. Continued use after the effective date means you accept the revised Terms.

11. Governing law

These Terms are governed by the applicable laws of the United States, without regard to conflict-of-law principles. Any dispute must be brought in a court of competent jurisdiction in the United States, except where applicable consumer law requires otherwise.

12. General

If a provision is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the entire agreement concerning this public Site and replace prior statements about Site use.
